These Terms of Service ("Terms") constitute a legally binding agreement between DevaSetu Technologies Private Limited ("DevaSetu", "Company", "we", "our", or "us") and any person accessing or using our website www.store.devasetu.com ("Website").

By accessing, browsing, registering on, or placing an order through the Website, you acknowledge that you have read, understood and agree to be bound by these Terms, our Privacy Policy, Return & Refund Policy, Shipping Policy and any other policies published on the Website.

If you do not agree with these Terms, you must immediately discontinue use of the Website.

2. Definitions

Unless the context otherwise requires:

  • "Business Day" means any day other than a Saturday, Sunday or public holiday in Rajasthan, India.

Placing an order on our Website constitutes an offer by you to purchase the selected Products.

Submission of an order does not constitute acceptance by DevaSetu.

An order shall be deemed accepted only when:

  • payment has been successfully received (where applicable); and

  • the order has been confirmed for dispatch by DevaSetu.

We reserve the right to refuse, cancel or limit any order at our sole discretion, including where:

  • the Product is unavailable;

  • pricing or product information contains an error;

  • fraudulent or suspicious activity is suspected;

  • payment cannot be verified;

  • delivery cannot reasonably be completed; or

  • compliance with applicable law requires cancellation.

If an order is cancelled before dispatch after payment has been received, the amount paid shall be refunded to the original payment method, unless otherwise required by law.

5. Product Information

We endeavour to ensure that all Product descriptions, specifications, photographs and pricing displayed on the Website are accurate.

However:

  • colours may vary depending on screen settings and lighting conditions;

  • Products made from natural materials may vary in colour, texture, grain, size, shape, markings or finish;

  • handcrafted Products may exhibit minor variations; and

  • packaging may change from time to time without affecting the Product itself.

Such variations are natural characteristics and shall not be treated as defects.

We reserve the right to modify Product descriptions, pricing, specifications or availability without prior notice.

6. Pricing

All prices displayed on the Website are in Indian Rupees (INR).

Unless otherwise stated, prices are inclusive of applicable GST.

Shipping charges, if applicable, shall be displayed separately during checkout.

Although every effort is made to ensure pricing accuracy, inadvertent errors may occur.

Where a pricing error is identified before dispatch, DevaSetu reserves the right to:

  • cancel the order;

  • refuse to process the order; or

  • contact the customer with the corrected price before proceeding.

7. Payments

We accept payment through the payment methods displayed on the Website.

Payments are processed through secure third-party payment gateways.

DevaSetu does not store or have access to complete credit card, debit card or banking credentials submitted through payment gateways.

An order shall be processed only after successful payment confirmation unless Cash on Delivery or another approved payment method is offered.

If a payment is declined, reversed or subsequently found to be fraudulent, DevaSetu reserves the right to cancel the order and pursue any remedies available under applicable law.

8. Customer Accounts

Certain features of the Website may require the creation of a customer account.

You agree to:

  • maintain the confidentiality of your login credentials;

  • accept responsibility for all activities conducted through your account; and

9. Customer Responsibilities

11. Shipping & Delivery

DevaSetu delivers Products across locations serviced by our logistics partners.

Estimated delivery timelines displayed on the Website are indicative only and shall not be construed as guaranteed delivery dates.

Delivery may be affected by circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters

  • Floods

  • Earthquakes

  • Pandemics

  • Government restrictions

  • Public holidays

  • Civil unrest

  • Courier operational delays

  • Weather conditions

  • Transportation disruptions

Such delays shall not constitute grounds for cancellation, compensation or refund where permitted under applicable law.

Risk in the Product passes to the customer upon successful delivery to the shipping address provided during checkout.

Customers are responsible for providing accurate shipping details. DevaSetu shall not be liable for delays or failed deliveries resulting from incorrect addresses, incorrect contact details or repeated delivery failures attributable to the customer.

12. Order Cancellation

Customers may request cancellation of an order only before it has been dispatched from our warehouse.

Once an order has been dispatched, it cannot be cancelled.

DevaSetu reserves the right to cancel any order before dispatch where:

  • payment cannot be verified;

  • fraudulent activity is suspected;

  • pricing or inventory errors are identified;

  • the Product becomes unavailable; or

  • cancellation is required for legal or operational reasons.

Where an order is cancelled by DevaSetu before dispatch after successful payment, the amount paid shall be refunded to the original payment method, unless otherwise required by law.

13. Returns, Replacements & Refunds

Returns, replacements and refunds are governed exclusively by our Return & Refund Policy, which forms an integral part of these Terms.

Customers are encouraged to read the Return & Refund Policy carefully before placing an order.

14. Spiritual Products Disclaimer

DevaSetu offers Products intended for religious, devotional and spiritual purposes.

The use of such Products is a matter of individual faith and personal belief.

Individual experiences may differ from person to person.

DevaSetu does not represent or guarantee that the purchase or use of any Product will result in any specific spiritual, religious, astrological, financial, professional, educational, health, relationship or personal outcome.

Customers acknowledge that dissatisfaction arising from personal beliefs, expectations or perceived spiritual outcomes shall not constitute a defect in the Product or grounds for cancellation, replacement or refund.

Accordingly:

  • textures may differ;

  • grains and natural markings may be visible;

  • dimensions and weight may vary slightly; and

  • handcrafted finishing may exhibit minor irregularities.

These characteristics are inherent to the nature of such Products and shall not be treated as manufacturing defects.

16. Disclaimer of Warranties

Except to the extent expressly required under applicable law, all Products and services are provided on an "as is" and "as available" basis.

DevaSetu makes no representations or warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose or non-infringement.

Nothing contained on the Website shall be construed as medical, legal, financial, psychological, astrological or professional advice.

Customers should exercise their own judgment before relying upon any information made available on the Website.

17. Limitation of Liability

To the maximum extent permitted by applicable law:

  • DevaSetu shall not be liable for any indirect, incidental, consequential, exemplary or special damages;

  • DevaSetu shall not be liable for loss of profits, goodwill, business opportunities or anticipated savings arising from use of the Website or Products; and

  • DevaSetu's aggregate liability arising from any order shall not exceed the purchase price actually paid by the customer for the Product giving rise to the claim.

Nothing contained herein limits liability that cannot legally be excluded under applicable law.

18. Force Majeure

DevaSetu shall not be liable for any delay or failure in performance resulting from circumstances beyond its reasonable control, including but not limited to:

  • acts of God;

  • epidemics;

  • fire;

  • flood;

  • war;

  • terrorism;

  • civil unrest;

  • labour disputes;

During such events, DevaSetu's obligations shall remain suspended only for the duration of the event.

31. Entire Agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy and any other policies published on the Website, constitute the complete agreement between you and DevaSetu regarding your use of the Website and purchase of Products.

They supersede all prior discussions, understandings or agreements relating to the same subject matter.

32. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

Nothing contained in these Terms shall limit or exclude any statutory rights available to consumers under applicable law.

33. Jurisdiction

Subject to applicable consumer protection laws, all disputes arising out of or relating to these Terms, the Website or any purchase made through the Website shall be subject to the exclusive jurisdiction of the competent courts at Bhilwara, Rajasthan, India.

34. Grievance Redressal

In accordance with the Consumer Protection (E-Commerce) Rules, 2020, DevaSetu has established a grievance redressal mechanism.
